Design and implementation of a defense strategy against sanctions from the Spanish Data Protection Agency (AEPD).

Challenge

A large company faced a €5 million fine imposed by the Spanish Data Protection Agency (AEPD), in the context of a procedure in which Several organizations participated, and it had an international reach.

The complexity of the case and the magnitude of the sanction demanded a robust defense strategy and precise coordination between the parties involved.

Approach

ECIX was hired after the notification of the sanction for design and implement a comprehensive defense strategy, coordinating efforts with the various international actors involved.

A detailed analysis of the case file's foundations was carried out, identifying possible inconsistencies in the sanctioning procedure and building a solid legal and technical argument.

The approach combined a thorough review of evidence with a proactive communication strategy towards authority, optimizing time and ensuring consistency between the claims presented by the different organizations.

Results

The intervention allowed reduce the penalty to 270,000 euros during the first phase of appeals, validating the effectiveness of the strategic approach and inter-institutional coordination.

Furthermore, it was achieved significantly shorten the duration of the sanctioning procedure, reducing operational impact, stress, and internal customer burnout.

The case was closed with an optimal result with respect to the initial purpose: to protect the organization's economic and reputational interests, avoiding significant financial harm and reinforcing its confidence in privacy management at a global level.
